In accordance with the Law on Execution of Criminal Sanctions, Detentions and Other Measures of BiH (‘’the Official Gazette of BiH’’ no: 13/05, 53/07, 97/07 and 37/09) the Parliamentary Assembly of BiH, at the 76th session of the House of Representatives, held on 21/04/2010, and the 47th session of the House of Peoples, held on 24/06/2010, appointed the members of the Independent Committee for the Monitoring of Conditions in Penal Institutions, of Treatment and of Respect for the Human Rights of Persons Subject to Criminal Sanctions and Other Measures Pronounced in Criminal Proceedings by the Court of Bosnia and Herzegovina or by International Courts for Acts Stipulated by the Criminal Code of Bosnia and Herzegovina or by an International Agreement Signed by Bosnia and Herzegovina or by Any Other Court In Accordance With Laws of Bosnia and Herzegovina
The Independent Committee for the Monitoring of Conditions in Penal Institutions, of Treatment and of Respect for the Human Rights of Persons Subject to Criminal Sanctions and Other Measures Pronounced in Criminal Proceedings by the Court of Bosnia and Herzegovina or by International Courts for Acts Stipulated by the Criminal Code of Bosnia and Herzegovina or by an International Agreement Signed by Bosnia and Herzegovina or by Any Other Court In Accordance With Laws of Bosnia and Herzegovina monitors the work of the penal institutions independently, or jointly with the inspectorial and monitoring bodies, and also in cooperation with international and other institutions responsible for the realization of human rights and basic freedoms, in accordance with the law and appropriate international documents.
The Committee submits an annual report to the Parliamentary Assembly of BiH and the Ministry of Justice of BiH , aiming to undertake appropriate actions or measures, in accordance with the law. The Parliamentary Assembly of BiH appoints and relieves from duties the appointed Independent Committee. The Committee consists of five members, including the Chairperson. The Chairperson and the members of the Committee are appointed for a term of five years, with the possibility of re-election for one further term. The members of the Committee should be experts or familiar with the law or other related fields including judiciary, administration, penology, social welfare, psychology, pedagogy, etc.
